This webinar will cover the second ethical principle of the NAADAC/NCC AP Code of Ethics, Confidentiality and Privileged Communication. Principle II focuses on treatment providers’ responsibility to protect the confidentiality of clients. This presentation will include a review of the latest legislation on 42 USC 290dd-2(b), which migrates a portion of the substance use disorder confidentiality regulations into HIPAA. Participants will be presented with both an update about and a discussion of the integration of the amended 42 USC 290dd-2. A review of the laws and ethical principle will also include discussion on the limits to confidentiality; when, with whom, and how information can be shared; and confidentiality as it applies to specific populations, such as minors and those in the criminal justice system. After a concise review of the second principle, the webinar will focus on case examples to highlight common ethical dilemmas that treatment providers face in everyday practice.

Presenters

Cynthia Moreno Tuohy, BSW, NCAC II, CDC III, SAP, is the Executive Director of NAADAC, the Association for Addiction Professionals, and has worked as an addiction professional for 48 years. She has been a trainer in Domestic Violence/Anger Management and Conflict Resolution for over 30 years as well as an international, national and state trainer. Moreno Tuohy is also a curriculum writer in addiction screening and evaluation, counseling methods, conflict resolution, co-occurring disorders, ethics, documentation, and medicated assisted treatment and recovery, and has written articles published in national and other trade magazines. Her book, Rein in Your Brain; from Impulsivity to Thoughtful Living in Recovery was released May 2014 through Hazelden Publishers. She has served as President of NAADAC, Certification Board Commissioner, International Chair, Treasurer and Legislative Chair for NAADAC.

Mita M. Johnson, EdD, LAC, MAC, SAP, CTHP-II, has been practicing in the world of mental health, marriage and family, and addictions counseling for the past 30 years. She earned her Doctorate degree in counselor education and supervision and is a core faculty member in the School of Counseling program at Walden University. She has a thriving private practice where she provides telebehavioral health services, clinical supervision, counseling to our military, and addiction-specific training and education. Her areas of specialization include pharmacology, co-occurring disorders, ethics, culturally-responsive care, and clinical supervision. She has been an active member of NAADAC for the last 15 years, has served as the Ethics Chair, and began her term as the NAADAC President in October 2020.

Learning Objectives

• Participants will be able to summarize the NAADAC/NCC AP Code of Ethics, Principle II.
• Participants will be able to describe areas of frequent ethical conflict that are specific to Principle II.
• Participants will develop strategies to avoid and resolve potential ethical violations regarding Principle II.

Beginner and Intermediate

• Beginning level courses introduce learners to a content area; include information about a condition, treatment method, or issue; and involve learning and comprehending content.
• Intermediate level courses provide information that builds on knowledge practitioners with some experience already have. These courses focus on skill-building or adding knowledge, possibly following a brief overview of basic information, and involve using information in concrete situations and understanding the underlying structure of the material.

A Certificate of Completion for 1.5 CEs is available by participating in this specialty online training and passing an online CE quiz. Those who successfully complete the full series and pass all six CE quizzes for this six-part series will be eligible to apply for the Certificate of Achievement for Ethics in Practice. 

1. Upon completing the webinar, you will have access to the CE quiz within the course you are taking. Find the CE quiz in the NAADAC Education Center and click on it.
2. A score of 80% or higher is required to pass the CE quiz and access your CE certificate. You have 10 opportunities to pass the quiz. If you are unable to pass the quiz in the allocated number of tries, then you must retake the course.
3. Upon passing the CE quiz, you will be required to complete the survey evaluation for the course. Once that is completed, your CE certificate will be immediately available to download in your account in the NAADAC Education Center.
